The Provincial Constitution of Hyperion
Preamble
By the order of the Governor of Hyperion, Xyrgistani Hyperion, with the approval of the Founder of the Union of Force, Renegalle, this Constitution is hereby established to facilitate justice and democracy, provide for mutual defense, and enable a future in which the Province of Hyperion becomes a fully-fledged state of the Federated Union of Force.

Article I
Citizenship and the Rights of Citizens


Section I: All the individuals in Hyperion are citizens
Section II: Citizenship shall only remain valid as long as the Citizen's nation remains in Hyperion
Section III: All Citizens are entitled to the rights outlined as such
The right to freedom of speech
The right to peaceful public assembly and protest
The right to equal protection under the law
The right to vote
The right to hold office in the Popular Assembly, apply for office in the Senate, and run for Consular seat

Section IV: The rights granted to citizens by the Provincial Constitution may be temporarily suspended as punishment for Constitutional Offenses, as a punishment determined by the High Court of the Union, or if the Governor deems it necessary for the good of Hyperion as a whole. The rights granted to citizens by the Union Constitution may not be suspended by anyone other than the High Court of the Union

Article II
The Government of Hyperion
The Government of Hyperion shall consist of the elected local government and the appointed Federal government

Section I: The Legislative Branch shall consist of two houses, the Popular Assembly and the Senate

Subsection I: The Popular Assembly:
The Popular Assembly shall be made up of all registered citizens of Hyperion
The Assembly may pass Bills. When Bills receive a majority in the Assembly and are signed by the Governor, they become laws. Bills are abbreviated as P. A. #
Bills may not contradict, suspend, or amend the Union Constitution, the Provincial Constitution, Federal Laws, or Provincial Orders
The Assembly may remove a Consul from office with a majority no-confidence vote if it deems their policies are not representative of the citizens' desires. To do so, the Assembly must have already chosen a replacement Consul, and no penalty may be levied upon the exiting Consul
The Assembly may impeach, remove from office, and bar from holding office a Consul for the Constitutional Offenses outlined in Article III with a supermajority
The Assembly will elect from itself a Tribune to preside over the Assembly

Subsection II: The Senate:
The Senate shall be made up of citizens nominated by the Governor and confirmed with a majority vote by the Popular Assembly
The Senate is an advisory body, and as such may with a tie or greater pass Resolutions which advise executive officers to take certain actions, change procedural rules, or form new governmental agencies. Resolutions are abbreviated Sen. Res. #
Resolutions may not contradict, suspend, or amend the Union Constitution, the Provincial Constitution, Federal Laws, or Provincial Orders
The Senate may impeach, remove from office, and bar from holding office a Consul for the Constitutional Offenses outlined in Article III with a unanimous vote
Senators will serve for life, or until they resign
The Senate will elect from itself a Praetor to preside over the Senate who will serve for two-month terms

Section II: The Executive Branch shall consist of the federal Governor, their cabinet, and the Consul

Subsection I: The Governor:
The Governor is Hyperion's Head of State and is appointed by and serves at the will of the Founder of the Union and the Federal House of Representatives.
The Governor may issue Provincial Orders which may not contradict, suspend, or amend the Union Constitution or the Provincial Constitution
The Governor may declare a state of emergency and/or dissolve any elected body of Hyperion at any time for no longer than thirty days unless the Founder or the Federal House approves an extension

Subsection II: The Cabinet:
The Cabinet is made up of the Imperator, the Praetor, and the Aedile
The Aedile will aid the Governor specifically in organizing region-wide events
The Prefect will aid the Governor in managing internal affairs and will keep a registry of all Popular Assembly members
The Imperator is the Governor's second in command and will manage the Cabinet when the Governor is not available

Subsection III: The Consul:
The Consul is the executive Head of Government, elected for two-month terms by all citizens of Hyperion. When the citizenship of Hyperion reaches fifteen, there will be two elected Consuls
The Consul may issue Executive Orders which do not contradict the Union Constitution, the Provincial Constitution, any Provincial Order, or any Law of Hyperion
The Consul may convene, adjourn, or force a vote on legislation in either legislative house unless the vote is a constructive no-confidence vote or an impeachment vote
The Consul may be removed with no penalty if a majority in the Comitia Assembly votes no-confidence with a constructive solution
The Consul may be impeached, removed from office, and barred from holding office again for Constitutional Offenses by either legislative house with a supermajority vote

Section III: The Judicial Branch: as a Province of the Union of Force, Hyperion does not have a legal system. Disputes among citizens and legal offenses will be determined in the High Court of the Union

Article III
Constitutional Offenses

Section I: Corruption is defined as the use of governmental office for personal or political gain. Punishable by immediate removal from office and temporary loss of the right to vote or run for public office for not less than four months and not more than one year.
Section II: Nonperformance is defined as a failure to adequately perform one’s duties while in office. Punishable by not more than removal from office.
Section III: Perjury is defined as willfully attempting to or successfully lie or deceive members of a judicial or impeachment proceeding. Punishable by immediate removal from office if applicable and a temporary loss of the right to vote or run for public office for not less than four months and not more than one year.
Section IV: Espionage is defined as willfully attempting to or successfully accessing and/or distributing sensitive information without the approval of the appropriate authority. Punishable by immediate removal from office and temporary loss of the right to vote or run for public office for not less than four months and not more than one year.
Section V: Piracy is defined as attempting to or successfully raiding Hyperion or any other regions of the Union of Force with malicious intent. Any nation found to be guilty of piracy, a citizen of Hyperion or not, is subject to immediate ejection and banishment from the Hyperion.
Section VI: Treason is defined as willfully attempting to or successfully undermining the legitimate government of Hyperion. Punishable by immediate removal from office if applicable, and the loss of the right to vote or hold public for not less than six months, or immediate ejection.
Section VII: Sedition is defined as willfully attempting to or successfully working with more than one member state to undermine the legitimate government of Hyperion. Punishable by immediate removal from office if applicable, the loss of the right to vote or hold public for not less than six months, and the loss of access to any Regional message board, or immediate ejection from Hyperion.
Section IIX: Conspiracy is defined as the willful, premeditated completion of any Constitutional offense with more than one member state. Conspiracy may not be a charge on its own, but instead must be charged as “Conspiracy to commit X.” Conspiracy will add to the punishment of the Constitutional offense the loss of access to any Regional message board of Hyperion, onsite or off.
Section IX: Any offense not defined in this list of Constitutional offenses which violates the Provincial Constitution is considered a malfeasance, with the punishment determined by the Judiciary.
Section X: As a Province of the Union, Hyperion does not have a Judicial System. Trials over Constitutional Offenses will be held by the High Court of the Union, with the exception of nonperformance, which will be decided by the Governor. Impeachment of officers will be decided by the Popular Assembly or the Senate.

Article IV
The Union of Force
Section I: Hyperion is a province of the Union of Force.
Section II: Hyperion and all the citizens of Hyperion are subject to the Union Constitution, Union Federal Laws, and Union Federal Executive Orders.


Article V
Amending the Constitution


Section I: The Provincial Constitution may be amended with a two-thirds vote of all citizens of Hyperion.
Section II: To be put to vote, a proposed amendment must have four endorsements by citizens of Hyperion
Section III: The Governor, the Founder of the Union, or the High Court of the Union may veto amendments if they determine the consequences of the passage of the amendment would be detrimental to Hyperion or if the amendment contradicts the Union Constitution or Union Federal Law
