It's ya boi, back at it again with a new constitutional review request, this time now just on this page, no link!


We the People of The Citizens Alliance of Democracy, establish this constitution in order to protect the rights of all citizens, to establish regional order, and ensure justice within the region.

ARTICLE I - THE LAW

Section A: The Constitution

I. This Constitution shall be regarded as the supreme territorial law of the land, second only to Federal Law.

II. This Constitution will be the framework of the government and its three branches, the executive, the legislative and the judicial.

Section B: Council Law

I. Council Law is defined as any legislation passed by the Citizens' Council.

II. Council Law may not contradict any laws written in the Constitution, or the Constitution of Force, though it can amend the Citizens’ Alliance’s Constitution.

III. Council Law may override or change any rules in the Citizens' Code.

Section C: The Citizens' Code

I. The Citizens' Code shall be a list of rules to be enforced within the Alliance. The rules in this Code shall be agreed upon by the Citizens' Council.

II. In this Code it will state all the rules regarding the use of sites and media officially used by the Alliance, including, but not limited to; the RMB, NS Forums, Discord. This is the basic etiquette to be observed by all citizens of the Alliance, and the corresponding punishments for breaking the laws in the Alliance or the Constitution of Force.

Section D: The Hierarchy of Law

I. The Hierarchy of the Law within this Alliance is as follows (in order of importance): Constitutional Law, Council Law, and Code Law.

II. As per the Constitution of Force, all laws stated in this Constitution, Council Law, or Code Law, shall be classified as Territorial Law, and shall be treated as such. It may be overridden by the Union Founder, the Prime Minister of Force, the House of Representatives, and other legislation by higher officials.

i. As such, Federal laws supersede laws within the Alliance.

ARTICLE II - CITIZENSHIP

Section A: Gaining Citizenship

I. Anyone who joins the region automatically gains citizenship.

II. Citizens must keep a nation within the region to maintain citizenship.

i. If a citizen’s nation ceases to exist, their citizenship shall be put on hold until the nation is refounded.

III. All citizens are entitled to exercise their rights as outlined in Section B.

Section B: Rights of Citizenship

I. All citizens have the right to be treated equally, regardless of race, gender, ethnicity, age, culture, disability, or origin.

i. Furthermore, all citizens have the right to be protected from any form of discrimination, slander, or personal attack.

II. All citizens shall have the right to freedom of speech.

i. This clause does not allow others to violate the rules of this Constitution, the Constitution of Force, or any platform used as an official venue of discussion or business by the Alliance.

ii. This includes but not limited to: The Regional Message Board, the official Discord Server, the official forums of the Union, and any other mode of communication used by members of the region.

iii. No citizen shall be allowed to harass, slander, or doxx another citizen.

iv. Harassment, as defined by the Constitution of Force, is the repeated or continuing contact serving no useful purpose except to create alarm, annoyance, or cause emotional distress.

v. Doxxing, as defined by the Constitution of Force, is publishing private or identifying information about an individual without their consent.

vi. No citizen is allowed to publish or state any information that could threaten the safety of the Alliance, and government officials have the right to suppress such posts if deemed necessary.

III. All citizens have the right to freedom of the press.

IV. All citizens have the right to run for office as long as they meet the requirements for said position.

V. All citizens have the right to petition the government.

VI. All citizens have the right to vote in an election.

VII. All citizens have the right to be notified by the government of any new laws, proposals, or announcements about the region as a whole. This duty is to be carried out by all members of the government, but the Archon is ultimately responsible for ensuring that the citizens are abreast of regional activities.

VIII. All citizens have the right to participate in roleplay.

i. This right may be revoked or suspended if one repeatedly violates the rules of roleplay issued by the Ministry of Regional Events.

IX. All citizens have the right to peaceful assembly.

X. All citizens have the right to apply to the Citizen’s Council.

ARTICLE III - THE GOVERNMENT

Section A: The Archon

I. The Archon shall be the third-highest-ranking official in the Alliance, after the Founder of the Union, and the Union's High Commissioner.

II. The Archon can issue Executive Orders which cannot suspend or amend any law but contradict it should they find it within reason and necessary for the safety and growth of the region.

III. The Archon is responsible for overseeing the projects done by the government and to ensure that laws are passed constitutionally.

IV. The Archon must write the recruitment and welcome telegram, and that shall be the telegram of the Alliance till the end of their term.

V. The Archon must also give a monthly report on the state of the region, to be published in the regional newspaper, provided said newspaper is operating at the time.

Section B: The Vice-Archon

I. The Vice-Archon shall be the fourth-highest-ranking official in the region, appointed by the Archon.

II. If the Archon is removed from office, on a leave of absence, or in any way unable to perform their duties, then the Vice-Archon shall take charge and be the acting Archon.

i. Accordingly, if the Vice-Archon is removed from office, is in anyway unable to perform their duties or the role is empty, then the Archon shall fulfill their role until such a time as a new Vice-Archon is chosen.

III. The Vice-Archon must contribute to the Archon's monthly report on the state of the region

IV. The Vice-Archon shall serve as an advisor to the Archon and they shall be in charge of notifying the Archon of any current issues facing the region.

V. The Vice-Archon may preside over the impeachment trials of the Archon should the need arise.

VI. The Vice-Archon must investigate all accusations of bias within the regional newspaper.

Section C: The WA Delegate

I. The WA Delegate shall be the Alliance’s main representative to the World Assembly and fifth in the line of succession.

II. The WA Delegate shall be in charge of encouraging member nations to join the WA.

III. The WA Delegate must give their suggestion on how to vote toward a proposal in the General Assembly and the Security Council, but cannot enforce it.

IV. The WA Delegate shall be in charge of making public announcements regarding new laws, proposals and other important issues.

V. The WA Delegate will be appointed by the sitting Archon.

i. If the Citizen’s Council hold a vote which is not in favour of the current Delegate, then the Archon must pick a new candidate.

VI. To be eligible for the position of WA Delegate, one must be a member of the World Assembly.

Section D: The Citizens' Council

I. The Citizens' Council shall be the legislative branch of the government.

i. This Council is subordinate to the Union's House of Representatives, and therefore can be overruled by said House.

II. The Archon shall preside over the meetings of the Council.

i. If the Archon is unable to preside over the meeting for any reason the Vice-Archon shall preside over the meeting.

III. Any member of the Council may propose a new bill, repeal, or amendment to the constitution.

IV. Whenever a new Council Law, Repeal, or Amendment has been proposed, the Archon must declare the Council as 'in-session' within 7 days of the proposal, provided that it is not already in session, at which point debate on the item will begin.

i. Each proposed law shall be given 24 hours each to be debated, challenged, or altered during this session.

ii. Once all proposed laws have been debated, the Archon must motion these proposals to be put to vote within the next 3 days.

V. Amendments can change, amend, or remove anything in this Constitution and they must gain a 2/3rd majority in the Citizens’ Council and signed by the Archon before taking effect.

VI. A Council Law must receive a simple majority to pass and afterward will be sent to the Archon and if they sign the bill, it becomes law.

i. If the Archon vetoes the bill and refuses to sign it, it will be sent back to the Council.

ii. The Council may override this veto with a two-thirds majority, if it fails to reach this majority, then it must be re-proposed.

VII. Council Repeals may remove Council Laws and must receive a simple majority to pass and afterward will be sent to the Archon for their signature before taking effect.

i. Standalone repeals may not be vetoed by the Archon.

VIII. Council Laws may have repeal clauses in them, which repeals any laws it aims to replace or remove.

i. Council Laws with repeal clauses will act and function like normal Council Laws, and therefore may be vetoed by the Archon.

ii. Council Laws with repeal clauses must have all of its repeal clauses as the first clause of the law and must explicitly mention which particular Laws it aims to repeal. If the Council Law fails to do this, it shall not be considered legal.

IX. To become a member of the Council, one must have held a nation within the region for a day, and also must register with the Vice-Archon Archon.

i. Registrations to join the Council shall be closed throughout the entire duration of the council in a session, to prevent individuals from signing up to influence specific votes without having been part of the council during the debate period.

ARTICLE IV - THE DIRECTORATES


Section A: Role and Structure of The Directorates

I. There will be three Directorates that will help govern the affairs of the region. These Directorates will be the Directorates of Internal Affairs, the Directorate of Regional Events, and the Directorate of Communication.

II. Each Directorate will be overseen by a Director who will be in charge of all the activities related to each ministry.

III. Each Director will be appointed to their position by the Archon.

IV. Directors can dictate how their Directorates are run and set policies as they see fit as long as they do not contradict this Constitution or other passed legislation.

i. Directors may appoint one Deputy Director to assist them in their duties, but it is not required.

V. Each of the Directorates will be under the oversight of the Archon and each Director must report on the status of their respective ministries
on a monthly basis.

VI. All Citizens have the right to join a Directorate as long as they contribute to their respective branch.

VII. The Archon may override any policies made by the Directorates via an executive order.

i. Policies that have been overridden can be reinstated via an appeal to the Citizens’ Council, who will vote on it.

Section B: The Directorate of Internal Affairs

I. The Directorate of Internal Affairs will be in charge of recruitment, and helping new members learn more about the region.

II. The Directorate will be in charge of recording the number of nations within the region.

III. The Directorate will be in charge of conducting investigations related to the security of the region. They will verify any claims made against a person or group.

Section C: The Directorate of Regional Events

I. The Directorate of Regional Events will be in charge of cultural activities in the region, celebrations and festivals, and regional roleplay.

II. The Directorate must find ways to get citizens to engage in the activities of the region. They must provide events that are enjoyable for everyone to keep them invested in the region provided they do not violate the Terms of Service of either NationStates or Discord.

III. The Directorate will also be in charge of the regional roleplay, outlining the rules and mechanics of the roleplay, and updating any maps, factbooks, dispatches and other necessary material related to the roleplay.

IV.The Directorate reserves the right to ban anyone from Roleplay, Contests or other regional events if they violate it's rules.

i. This is to be a matter of last resort, to be administered after providing and individual multiple attempts to correct their rule violating behaviour.

ii. Exceptions from the previous subclause can be made for explicit cheating such as those who use multiple accounts to partake in a contest.

Section D: The Directorate of Communications

I. The Directorate of Communications will be in charge of publishing and maintaining the regional newspaper and disseminating information and relevant government media to the public.

II. The Directorate must publish the regional newspaper monthly detailing all the major events which occurred during the past month.

III. The Directorate must also help promote independent journalism and freedom of the press as per Article 1 Section B Clause 3.

i. Furthermore, the Ministry must make sure that the media it publishes is politically unbiased and factually correct.

ii. If any citizen feels that any section of media provided by the Directorate is unfair or factually incorrect, they may raise this issue with the Vice-Archon, who is required to investigate such issues, and to remove any instances of unfair and incorrect news that are found following such an investigation.

ARTICLE V - ELECTIONS

Section A: Procedure

I. Per Article II, Section B, Clause 6, all citizens hold the right to vote.

II. Per Article II, Section B, Clause 4, all citizens hold the right to run for governmental office provided they meet the requirements of the position.

III. Archon elections are to be held at the last week of November, March and July.

i. These dates are set to be within the same month as the Union’s General Elections but set at the end of the month to prevent confusion.

ii. Candidates are to announce their candidacy within the first 3 days of the election week.

iii. Once the candidacy announcement phase has been concluded, it shall be followed by a 3-day debate period, within which citizens may submit questions for the candidates to answer.

iv. Following the conclusion of the debate period, the voting period shall commence, for a period of the 3 days.

IV. The phase lengths can be shortened by a singular day, should the circumstances require it. However, they cannot be shortened once the phase begins.

V. In situations where there are more than two candidates, a preference system shall be used. Voters will rank their preferred candidates from 1 being their favourite, 2 being the second favourite, and so on as far as the voter wishes to rank candidates.

i. Only a voter’s first preference shall be counted initially. Provided a candidate achieves a majority after this, the election is considered concluded, and no further counting will be done.

ii. In situations where no candidate achieves a majority, the candidate with the least votes shall be eliminated from the race, and the second preference votes of that candidate’s voters shall be counted instead.

iii. This process shall continue until a candidate achieves a majority. If all of a voter’s preferences are eliminated from the race, their ballot is no longer used for counting.

iv. Abstentions are not to be considered in the determination of whether a candidate has achieved a majority or not.

v. If this process does not result in a candidate achieving a majority, another vote shall be held, following the same standards of the last vote, lasting a singular day. This shall be repeated until a candidate achieves a majority.

VI. The Founder shall be in charge of managing the elections. He shall determine the way citizens shall vote, the medium used for voting, and collection of the ballots.

VII. No one is allowed to hold more than one elected position at a time.

i. Exceptions can be made during times of emergencies, low population, or absences of government officials.

VIII. The Archon or the Founder has the right to call for a snap election, should they deem it necessary.

ARTICLE VI - THE COURT

Section A: Construction and Procedure of the Court

I. The Court of the Citizens' Alliance of Democracy shall be known as The Alliance Tribunal.

II. The Court shall be constructed of three Justices, who are elected.

i. If a Justice leaves, is removed from office or departs from the job in any other manner, between elections, the Archon may appoint a new justice, if the next election is not within two weeks.

ii. The territorial Justices shall be tasked with hearing out criminal court cases within the Region, presented by either the Regional Government or by its citizens, provided that they are not federal crimes, which must be tried by the Federal Court.

III. When a territorial court case is presented to the Alliance Tribunal, it shall be reviewed by the three territorial Justices to determine whether or not the case is legitimate. If it is deemed valid, then the case will be accepted.

i. Once a court case has been accepted, the defendant has up to a week to enter their plea, of either not-guilty, guilty or no-contest.

ii. In the case of a guilty or no-contest plea, the case will move directly to sentencing, skipping the trial phase entirely.

iii. In the case of a not-guilty plea, the case moves to the trial phase, where the Justices pick one of their number to oversee the case.

iv. During the trial phase, a jury of 3 individuals shall be selected by the Justices.

v. Each trial shall consist of three phases: Opening statements, witness testimony/evidence presentation and finally the closing arguments.

vi. Opening statements are the statements provided by the plaintiff and defendent which represents their respective arguments surrounding the case.

vii. Witness testimoney/evidence presentation consists of the prosecution and defense providing witness and/or evidence that they believe aids their case.

viii. Closing arguments consists of the closing remarks by both parties, which can include refutations towards witness testimonies or evidence. Once this phase has ended, the case will be given to the Jury to deliberate.

ix. The Jury will have 5 days to determine whether the defendent is guilty or innocent, based on the evidence provided. To do so, they must reach a simple majority, ensuring they have no reasonable doubt as to whether the defendent is guilty, if that is what they determine.

x. The Justices then have the collective responsibility to hand out a fair and appropriate punishment if found guilty or plead no contest, though punishments for crimes may be outlined in a Citizens' Council Law outlining crimes within the Alliance.
