Representative Proposals / Amendment X: The Temple Act

Amendment X: Temple Amendment

Purpose: Close the impeachment loophole

Author(s): Empire of Elysium, West Kronisia

Existing Article, Article A:  Citizenship
1. All individuals in the Union are citizens.
2. Citizenship shall entitle individuals to the rights outlined in Article B.
3. Citizenship may only be removed by the Court as a punishment following a criminal trial. Rights of Citizenship may be removed by the Court for the same reason, but only temporarily.
4. Citizenship shall only remain valid as long as the citizen's nation remains in the Union.
5. Citizens residing in the region a representative represents may vote to remove them from office. They shall do so by holding a democratic vote, overseen by the Speaker, in which a simple majority of votes in favor of the removal, within 3 days, is required to remove the Representative. To vote, a citizen must have resided in that region prior to the vote being held.
6. Citizens shall hold the power to force a vote in the House of Representatives on any proposed House Law or Constitutional Amendment. At least five citizens must sign a motion putting forward such a proposal, after which the House shall be obliged to hold a vote on the legislation within one week.

5.1 In the case of Union-wide Representatives, any Union Citizen may request a vote to remove a Representative from Office. This shall follow the same procedure as Regional Representatives, and similarly, the Citizen must have resided within the Union prior to the vote being held.

Brief Overview

The Debate period is intended to be a time in which citizens can assess the competence of candidates running for office and make an informed decision in the voting period that follows. All citizens may ask questions to the candidates and while the candidates are not legally bound to answering these questions, it is highly encouraged. Candidates are however legally bound to answer all questions asked of them by the Founder.

1. Which House Bills do you plan to create, pass or repeal? Why?

2. In what ways should the Constitution be amended, if at all? How would this improve the Constitution?

3. What qualifies you to serve in the House? What makes this qualifying?

4. If elected, do you plan on running for Speaker? If so, what makes you a good candidate for this position and if not, who do you think would be a better candidate?

5. How will you ensure that your constituents' voices are heard in the house?

6. What reforms would you make to the house itself, if any? This can be in terms of structure, how the House conducts its work, or in any other manner.

Required: Questions for All High Court Candidates

1. Are you perfectly selected with Jury selection as is? If not how can it be reformed?

2. The Justices are responsible for determining whether any laws contradict the Constitution. With this power in mind, what method(s) would you use to come to a decision as to the legality of a law? If a law was not necessarily illegal but went against the character of the Constitution, would you consider that fair grounds for it to be overturned?

3. Do you believe it is more important to take your time when deciding the verdict for a case, even if it means the guilty party goes longer without punishment, or do you believe it is more important to quickly decide on a verdict, even if it means the punishment may not be as suitable as otherwise? What factors would tilt this more in favour of one or the other?

4. Similarly to Q2, if a case was brought to the court against someone who had not necessarily done something that was illegal, but went against the character of the Constitution, would you consider that fair grounds for the case to be considered?

5. In what way, if at all, would you like to see the Judiciary changed or reformed?

1. The Justices are responsible for deciding the punishment for a person found guilty, following a trial. You are required to do so with the advice of the Jury. With this in mind, how would you balance your own thoughts on how harsh punishment should be with the Jury's recommendation?

2. The Justices are responsible for determining whether any laws contradict the Constitution. With this power in mind, what method(s) would you use to come to a decision as to the legality of a law? If a law was not necessarily illegal but went against the character of the Constitution, would you consider that fair grounds for it to be overturned?

Up for Election: The office of Prime Minister, 3 or 5 Court Justices (dependent on how many candidates run), and seats in the House of Representatives. There are 6 seats up for election representing Force, 5 representing RGBN, 2 representing Heart, and up to 1 from each territory.

Prime Minister

Responsibilities and Privileges: "The Prime Minister of Force shall be the Union’s head of government and shall be responsible for actively leading it and overseeing the Cabinet."
The Prime Minister has the job of administering the entire Union and ensuring it enjoys prosperity as well as stability.

Term Length: 4 months

House Representatives

Responsibilities and Privileges: The House of Representatives holds three distinct powers: the ability to pass laws to complement and expand upon the Constitution (but not contradict it), the ability to begin the amendment process (all Constitutional Amendments must start in and be approved by the House, before going to the citizenry for a vote), and the ability to remove government officials who fail to perform their responsibilities adequately or misuse their power (including the Prime Minister and members of the Court).

Term Length: 4 months

Justices
Responsibilities and Privileges: The Court Justices shall be responsible for overseeing and ensuring the speedy delivery of justice in trials, delivering verdicts on court cases, and judging the legality of passed House Bills. There are three justices on the Court.

What is it?
A public club to post about fishing, hunting, hiking, gardening, and anything else of the source. A club for anyone who loses the outdoors even if it is just a beach trip and collecting a few shells, or hunting every day of the week. This is also a club for people to share tips and tricks on their hobbies to other interested in it. Other good uses include sharing outdoors photos.

Rules:
1) Don’t encourage activities particularly cruel to animals (ie. trophy hunting, other types of hunting at good though).
2) Don’t post gore without a warning an spoiler tag
3) Don’t disparage others on their achievements  in a disrespectful manners

House / Farewell from the House of Representatives

Office of Empire of Elysium:Farewell from the House of Representatives.
As we near the end of my career within the House of Representatives, for the foreseeable future, I would like to take a moment to thank my constituents in Heart for allowing me the honor to serve as your region’s Representative. I would also like to thank Sir Salibaic, who for much of this time has been a fellow representative in Heart, as leader of the DPP and now Federalist Party he has helped me in my political journey I have enormous respect for him due to that. Last I would like to congratulate my successor Tenjouin and I wish him a successful tenure.

Thank you to my fellow Representatives, former Speaker Suter, Founder Renegalle, and PM Caduceu who have also been friends and political allies, with exception of the ever neutral presence of the Founder, throughout my career and have helped guide me. As for my replacement as Leader of the House I nominate Suter should he seek the office.
